Effective Date: August 12, 2026
Last Updated: August 12, 2026
These Terms and Conditions (the “Terms”) govern your access to and use of the Fleet Connect website, applications, and related services (collectively, the “Platform” or “Web Services”) provided by Fleet Connect, LLC (“Fleet Connect,” “we,” “us,” or “our”).
By creating an account, clicking “I Agree,” purchasing a subscription or report, or otherwise accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not access or use the Platform.
Fleet Connect grants you a limited, nonexclusive, revocable, nontransferable right to access and use the Platform for lawful business purposes, subject to these Terms.
1) Account Access; Eligibility; Authorized Use
Access to the Platform is provided through an online account you create. You agree to provide accurate, current, and complete information and to keep your account information updated.
You may use the Platform only:
- for lawful business purposes; and
- in compliance with these Terms and applicable law.
Fleet Connect may suspend, limit, or terminate your access as described in these Terms.
Account Types. The Platform offers two types of accounts:
- Individual Accounts, registered with a personal email address, limited to a single (1) Authorized User; and
- Business/Organization Accounts, registered with an email address associated with the organization’s business domain, which may include up to three (3) Authorized Users per subscription. Additional seats beyond the included three (3) may be purchased for an additional monthly fee as published on Fleet Connect’s pricing page.
Fleet Connect may verify account type eligibility and, in its sole discretion, reclassify, limit, or suspend an account that does not meet the requirements of its designated type.
2) Account Holder Responsibility
You represent and warrant that:
- you are at least 18 years old (or the age of majority where you live); and
- you have the legal authority to enter into these Terms on behalf of yourself and, if applicable, your employer or organization.
If you use the Platform on behalf of an organization, you are responsible for ensuring your use complies with your organization’s policies and applicable laws.
Business/Organization Accounts; Authorized Users. If you register a Business/Organization Account, you are the “Account Owner” and are responsible for all Authorized Users provisioned under the account, including their compliance with these Terms and any acts or omissions by them in connection with the Platform. Each Authorized User must independently read and accept these Terms and use their own individual login credentials before accessing the Platform, regardless of whether the Account Owner created or invited them to the account, and each Authorized User is independently bound by these Terms as to their own use of the Platform.
3) No Sharing; No Resale; No Transfer
You may not share your username, password, access keys, tokens, or other credentials with any other person. You may not permit any third party to access the Platform through your account.
This Section does not prohibit a Business/Organization Account from provisioning separate, individual credentials to up to three (3) Authorized Users (plus any additional purchased seats) as described in Section 1. Each Authorized User must maintain their own unique credentials; sharing credentials among Authorized Users, or granting access to anyone who is not a designated Authorized User, remains prohibited.
Session Limits. To help enforce these limits, each individual login (whether an Individual Account or an Authorized User under a Business/Organization Account) is limited to one active session at a time. Signing in on a new device or browser will automatically end any other active session for that login. Fleet Connect is not responsible for any unsaved data lost as a result of a session being ended under this policy.
You may not:
- resell access to the Platform;
- provide “service bureau” access;
- offer the Platform’s outputs as a standalone product to third parties; or
- otherwise make the Platform available to any third party without Fleet Connect’s prior written consent.
Any attempt to transfer access in violation of this section is void.
4) Intellectual Property; Ownership of Platform
The Platform, including all software, source code, algorithms, workflows, user interface, branding, designs, trademarks, logos, graphics, and content made available by Fleet Connect (collectively, “Fleet Connect Materials”) are owned by Fleet Connect and/or its licensors and protected by intellectual property and other laws.
Except for the limited rights expressly granted in these Terms, Fleet Connect reserves all rights, title, and interest in and to the Platform and Fleet Connect Materials. No rights are granted by implication, estoppel, or otherwise.
This provision survives termination of your access.
5) Feedback
If you submit feedback, suggestions, ideas, or recommendations regarding the Platform (collectively, “Feedback”), you grant Fleet Connect a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable right to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose, without compensation or attribution to you.
6) Acceptable Use; Restrictions; No Scraping; No Public Posting
Unless Fleet Connect expressly authorizes otherwise in writing, you may not (and may not allow others to):
- Share credentials or permit access by anyone outside your organization;
- Copy, reproduce, distribute, republish, upload, post, transmit, publicly display, or publicly perform Fleet Connect Materials or Platform outputs in a way that makes them available outside your organization;
- Scrape, crawl, spider, harvest, or use automated means (including bots, scripts, agents, or scrapers) to access the Platform or extract content;
- Bypass or interfere with security controls, paywalls, rate limits, or access restrictions;
- Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying ideas from the Platform (except where prohibited by law);
- Use the Platform to build or enhance a competing product or service;
- Use the Platform for benchmarking or competitive analysis intended for external publication;
- Introduce malware or otherwise disrupt the Platform’s operation or security.
Fleet Connect may implement technical measures to detect and prevent unauthorized access and misuse, and may impose usage limits or restrictions to protect Platform performance and integrity.
Exports and Abuse Controls. Fleet Connect may impose export limits, rate limits, throttling, authentication requirements, and/or watermarking of exported files (including PDFs and CSVs) to prevent abuse, unauthorized distribution, or excessive usage.
Use of Contact Information. If the Platform provides business contact information, you may use such information only for lawful business-to-business communications and only in compliance with applicable law. Without limiting the foregoing, you may not use contact information obtained from the Platform to:
- send unsolicited bulk emails or spam;
- make or facilitate robocalls, auto-dialed calls, or text message campaigns without required consent;
- violate do-not-call, anti-spam, telemarketing, or similar laws; or
- sell, license, or redistribute contact information to third parties (including compiling lists) without Fleet Connect’s prior written consent.
This provision survives termination of your access.
7) Subscriptions; Purchases; Billing; Auto-Renewal; Cancellation
Certain features require payment, including subscriptions (monthly and annual plans) and/or one-time purchases such as reports.
By purchasing, you authorize Fleet Connect (and our payment processors) to charge your selected payment method for:
- subscription fees (monthly or annual, as selected),
- one-time purchases,
- applicable taxes, and
- any other charges you approve.
No Trial. Unless Fleet Connect expressly states otherwise in writing, access to paid features begins upon successful payment; no trial is provided.
Auto-Renewal. Monthly subscriptions renew monthly, and annual subscriptions renew annually, unless you cancel before the renewal date.
Annual Billing. Annual subscriptions are billed upfront for the full annual term.
Cancellation. You can cancel at any time through your account settings or other method we provide. Cancellation stops future renewals and typically takes effect at the end of the then-current billing period/term, unless otherwise stated at purchase.
Failed Payments; Past Due Accounts. If your payment method fails or your account becomes past due, Fleet Connect may suspend or terminate access until payment is received.
Chargebacks. You agree not to initiate chargebacks or payment disputes without first contacting Fleet Connect to attempt resolution. Fleet Connect may suspend or terminate accounts associated with chargebacks or unpaid balances.
Pricing/Plan Changes. Fleet Connect may change pricing or plan features from time to time. If changes apply to an ongoing subscription, we will provide notice as required by law and/or within the Platform.
Additional Seats. Business/Organization Accounts may purchase additional seats beyond the three (3) Authorized Users included with a subscription, for an additional monthly per-seat fee as published on Fleet Connect’s pricing page at the time of purchase.
8) Refund Policy
All fees are non-refundable except as required by law or as expressly stated by Fleet Connect in writing.
Subscriptions:
- We do not provide prorated refunds or credits for partial subscription periods or unused time.
- If you cancel, you retain access through the end of your current billing period/term.
One-Time Reports:
- Because reports are digital content delivered immediately, one-time report purchases are final once a report is generated, delivered, or accessed, and are non-refundable.
Limited Exceptions: Fleet Connect may issue a refund or credit in limited cases such as verified duplicate charges, a billing error attributable to Fleet Connect, or extended service unavailability that materially prevents access to paid features.
9) Changes to the Platform or Terms
Fleet Connect may update the Platform and may amend these Terms from time to time. Updated Terms become effective when posted or otherwise made available.
Your continued use of the Platform after updated Terms become effective constitutes acceptance of the updated Terms.
10) Privacy Policy
Fleet Connect maintains a separate Privacy Policy that describes how we collect, use, and share information. The Privacy Policy is incorporated by reference into these Terms. If there is a conflict between these Terms and the Privacy Policy regarding privacy-related matters, the Privacy Policy will control.
11) Data Sources and Disclaimers
The Platform’s data is derived primarily from information made publicly available by the Federal Motor Carrier Safety Administration (“FMCSA”), including the SAFER System, Company Snapshot, and related FMCSA data systems, as well as other public records and/or third-party sources, and may include Fleet Connect analyses, summaries, or scores. Fleet Connect is an independent platform and is not affiliated with, endorsed by, or sponsored by the U.S. Department of Transportation, FMCSA, or any government agency. Fleet Connect does not guarantee the completeness, accuracy, timeliness, reliability, or suitability of any information on the Platform. Data may be incomplete, outdated, reclassified, corrected, or removed without notice.
Scores, BASICs, and ISS. The Platform may display BASICs, ISS scores, and other safety-related indicators that are calculated or recalculated using publicly described FMCSA methodologies and available data. These scores are provided for informational purposes only, may differ from FMCSA or third-party scores, and should not be interpreted as official FMCSA outputs. Scores are not a guarantee, prediction, or certification of any carrier’s actual safety performance, compliance status, or suitability for any purpose, and must not be used as the sole basis for any hiring, contracting, underwriting, or other business decision. FMCSA scoring methodologies, thresholds, and underlying data change over time, and Platform scores may not reflect the most current FMCSA data or methodology at any given time.
Contact Information Disclaimer. The Platform may display business contact information obtained from public records and/or third-party sources, available only through a paid subscription or paid report purchase as described in Section 12. Such contact information may be incomplete, inaccurate, outdated, or associated with the wrong entity. You are responsible for verifying contact information and for ensuring you have any required permissions or consent prior to using it.
Not a Consumer Report. The Platform is not a “consumer reporting agency,” and Platform outputs (including scores, Risk Indicators as defined below, and contact information) are not “consumer reports,” as those terms are defined under the federal Fair Credit Reporting Act (FCRA) or any similar state law. Platform outputs are not intended to be used, and may not be used, in whole or in part, as a factor in determining eligibility for credit, insurance, employment, housing, or any other purpose that would require FCRA compliance. If you use the Platform in a manner that triggers FCRA or similar obligations, you are solely responsible for complying with all applicable requirements, and Fleet Connect disclaims any responsibility or liability arising from such use.
The Platform is provided for informational and business purposes only and does not constitute legal, regulatory, compliance, insurance, safety, financial, employment, or other professional advice. You are solely responsible for independently verifying any information obtained through the Platform and for all decisions and actions you take based on Platform content. Fleet Connect assumes no liability for decisions made in reliance on Platform data.
12) Fraud and Risk Indicators
Access Conditioned on Acceptance. Risk Indicators (as defined below) and full safety scores and BASIC/ISS detail are not available to unregistered visitors and are accessible only through a paid subscription or paid report purchase. By purchasing or accessing any such content, you acknowledge that you have read, understood, and agreed to be bound by this Section 12 and these Terms in their entirety, and that access to such content is expressly conditioned on that agreement.
The Platform may display fraud detection alerts, risk indicators, or similar flags (“Risk Indicators”), which may include indicators relating to potential carrier reincarnation or other overlapping business records identified through automated pattern-matching or analysis of public records and/or third-party data.
Risk Indicators reflect data patterns and statistical associations only. They do not constitute, and must not be interpreted as, a determination, finding, accusation, adjudication, or conclusion that any carrier or individual has engaged in fraud, misconduct, or any unlawful or improper activity.
Risk Indicators may result from legitimate business practices, including shared registered agents, virtual offices, staffing arrangements, corporate restructuring, common ownership among affiliated but distinct entities, or coincidental overlap in publicly available data, and may be incomplete, inaccurate, or outdated.
By using the Platform, you agree that:
- Risk Indicators are intended solely as a prompt for your own further independent investigation, and not as a final determination of any kind;
- you will not represent, publish, state, or communicate to any third party — including the carrier or individual identified — that a carrier or individual has been “confirmed,” “found,” or “determined” to have engaged in fraud based on a Risk Indicator alone; and
- you are solely responsible for any business, legal, or other decisions made in reliance on a Risk Indicator, including any decision to decline, terminate, restrict, or condition a business relationship with a carrier.
FLEET CONNECT MAKES NO REPRESENTATION OR WARRANTY REGARDING THE ACCURACY OF ANY RISK INDICATOR, AND DISCLAIMS ALL LIABILITY ARISING FROM YOUR RELIANCE ON, OR PUBLICATION OR COMMUNICATION OF, ANY RISK INDICATOR.
13) Compliance Responsibility
You agree that you are solely responsible for your use of the Platform and Platform content and for complying with all applicable laws, rules, and regulations, including laws relating to privacy, marketing/solicitations, consumer protection, and permissible use of public or third-party data.
14) Confidentiality / Non-Disclosure
The Platform may provide data compilations, analytics, scores, summaries, and outputs — including exported PDFs and CSVs — that reflect Fleet Connect’s proprietary organization, formatting, scoring, presentation methods, and/or paid features (collectively, “Subscriber Outputs”). You may use Subscriber Outputs only for your internal business purposes.
You agree not to disclose, publish, distribute, sell, license, sublicense, provide access to, or otherwise make Subscriber Outputs available to any third party outside your organization without Fleet Connect’s prior written consent. You may share Subscriber Outputs internally within your organization with personnel who have a legitimate business need to know and who are bound by confidentiality obligations at least as protective as these Terms.
This section does not prevent you from using publicly available information that you obtained outside the Platform.
15) No Warranties; “AS IS” / “AS AVAILABLE”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FLEET CONNECT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
FLEET CONNECT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
16) Unauthorized Sharing; Remedies; Injunctive Relief
Unauthorized sharing, redistribution, or publication of Platform content may cause Fleet Connect harm that is difficult to measure.
If you violate these Terms by providing Platform access to an unauthorized third party or disclosing, exporting, redistributing, publishing, or posting Platform content outside your organization in violation of these Terms, Fleet Connect may (a) suspend or terminate your account, and (b) seek injunctive relief and any other remedies available at law or equity, including recovery of actual damages and reasonable costs of enforcement.
17) Violations; Suspension or Termination
Fleet Connect may suspend, limit, or terminate your access (with or without notice) if we determine, in our sole discretion, that you:
- violated these Terms;
- engaged in fraudulent, abusive, or unlawful activity;
- attempted unauthorized access, scraping, circumvention, or credential sharing; or
- pose a security, compliance, legal, or business risk.
Upon termination, you must cease all use of the Platform.
Data Retention. After termination or cancellation, we may retain certain account, billing, audit, and security records as reasonably necessary for legal, compliance, dispute resolution, or legitimate business purposes, consistent with our Privacy Policy.
Sections that by their nature should survive termination will survive, including without limitation: Intellectual Property, Restrictions, Feedback, Refund Policy, Disclaimers, Fraud and Risk Indicators, No Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Survival.
18) Limitation of Liability
To the maximum extent permitted by law, Fleet Connect will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, loss of data, or business interruption, arising out of or related to your use of (or inability to use) the Platform, even if Fleet Connect has been advised of the possibility of such damages.
To the maximum extent permitted by law, Fleet Connect’s total aggregate liability arising out of or relating to these Terms or the Platform will not exceed the amounts you paid to Fleet Connect in the three (3) months preceding the event giving rise to the claim (or $100, if you have not paid Fleet Connect).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
19) Indemnification
You agree to defend, indemnify, and hold harmless Fleet Connect and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use of the Platform in violation of these Terms;
- your violation of applicable law;
- your unauthorized disclosure, distribution, or misuse of Platform content; or
- your publication, communication, or use of any Risk Indicator, score, or other Platform output in a manner not permitted by these Terms.
20) Force Majeure
Fleet Connect will not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, natural disasters, labor disputes, war, terrorism, civil disturbances, government actions, internet or hosting provider failures, and power outages.
21) Electronic Communications; Notices
You consent to receive communications from Fleet Connect electronically (for example, by email, in-app notifications, or posting notices on the Platform). You agree that such communications satisfy any legal requirement that notices be in writing.
22) Governing Law; Arbitration; Venue
These Terms and your use of the Platform will be governed by and construed in accordance with the laws of the State of Wyoming, excluding conflict of laws rules to the extent such rules would apply the law of another jurisdiction.
Arbitration: Any controversy or claim arising out of or relating to these Terms or the Platform, or the breach thereof, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Wyoming, before a single arbitrator, under AAA rules. Judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver: YOU AND FLEET CONNECT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Jury Trial Waiver: TO THE EXTENT ANY DISPUTE IS NOT SUBJECT TO ARBITRATION, YOU AND FLEET CONNECT EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.
Injunctive Relief Carve-Out: Notwithstanding the foregoing, Fleet Connect may seek temporary, preliminary, or permanent injunctive relief (and other equitable relief) in a court of competent jurisdiction to prevent unauthorized access, scraping, credential sharing, or misuse/disclosure of Fleet Connect Materials.
Attorneys’ Fees: The prevailing party shall be entitled to recover its attorneys’ fees and costs.
23) Assignment
You may not assign or transfer these Terms (or your account or access rights) without Fleet Connect’s prior written consent. Fleet Connect may assign these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, without notice to you. Any attempted assignment in violation of this section is void.
24) Waiver
No waiver, supplement, modification, or amendment of these Terms is binding unless executed in writing by a duly authorized representative of Fleet Connect. Failure to enforce any provision will not constitute a waiver of future enforcement.
25) Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
26) No Third-Party Beneficiaries
These Terms are for the benefit of you and Fleet Connect only. Nothing in these Terms confers or is intended to confer any right or benefit on any third party, including any motor carrier, individual, or business referenced, described, scored, or flagged in Platform content.
27) Headings
Headings are for convenience only and do not affect interpretation.
28) Entire Agreement
These Terms, together with any documents incorporated by reference (including the Privacy Policy), constitute the entire agreement between you and Fleet Connect regarding the Platform and supersede any prior or contemporaneous understandings.
29) Survival
These Terms will survive your acceptance and use of the Platform and will continue to apply after your access ends to the extent required by their nature.
